Fair Use Policy

This policy applies to the Metered Features of the FanEngine Platform: MCP access, APIs, agent-based and AI-assisted features, and data exports. It is incorporated into the FanEngine Creator Terms and Conditions. Capitalized terms have the meaning given in those Terms. Plan limits are stated on the Creator's Order Form; Metered Feature limits are stated in this policy.

1. What Metered Features are for

Metered Features are provided so that a Creator and its Authorized Users can analyze, understand, and act on the Creator's own fan data within the FanEngine Platform. Use is limited to the Creator's internal business purposes in connection with its relationship with its own fans.

2. What is not allowed

You may not use Metered Features to:

• extract, copy, or reconstruct the Creator's fan database, or any substantial portion of it, outside the FanEngine Platform, whether in one request or through repeated requests;
• run automated, scripted, or scheduled queries at a rate or volume that is inconsistent with normal analytical use;
• share credentials, tokens, or MCP connections with anyone who is not an Authorized User, or allow access on behalf of a third party;
• resell, sublicense, or provide access to Metered Features or their output to any third party;
• build, train, benchmark, or improve any product or dataset that replicates or competes with the FanEngine Platform; or
• access or attempt to access data belonging to any other creator.

Using Metered Features through FanEngine-provided MCP connections, APIs, or agents with an AI assistant of your choice, for the purposes in Section 1, is permitted.

3. Current limits

Limits apply per Creator account across all Authorized Users. Current limits are:

• MCP and API requests: 10,000 per day
• Concurrent MCP sessions: 5

Limits for agent tasks and data exports will be published here when those features launch or as usage patterns become clear; until then FanEngine reviews export requests and agent usage case by case under Sections 4 and 5. FanEngine may raise limits on request where the use case fits Section 1.

4. Data exports

Exports must be requested by an Authorized User, are logged, and are limited to the Creator's own fans. Exported data must be handled in accordance with applicable privacy law and the Creator's own privacy policy, and is the Creator's responsibility once it leaves the FanEngine Platform. FanEngine may pause export rights, without affecting analytics access, while it reviews activity that appears inconsistent with this policy.

5. Agents and AI-assisted features

Outputs of agent-based and AI-assisted features are generated automatically and are provided for the Creator's review. The Creator is responsible for reviewing outputs before relying on them or sending any communication to fans. FanEngine may make agent features available by plan and may adjust which agents and how many agent tasks are included in each plan, as stated in this policy and the Creator's Order Form.

6. How FanEngine enforces this policy

If usage approaches or exceeds a limit, FanEngine will generally throttle the affected Metered Feature first and notify the account owner by email. If usage continues, or if FanEngine reasonably believes an account is being used for bulk extraction, unauthorized sharing, or any other purpose prohibited by Section 2, FanEngine may suspend the affected Metered Feature until the issue is resolved. Analytics access through the FanEngine interface is not affected by a Metered Feature suspension unless the conduct also breaches the Terms. Repeated or serious violations are a material breach of the Terms.

7. Changes to this policy

FanEngine may update this policy from time to time. Changes take effect on notice to the account owner's email on file or 14 days after posting at fanengine.ai/fairuse, whichever is earlier, except that any reduction in limits for an existing plan takes effect at the account's next billing date. The current version and its effective date are always shown at the top of this page.
